FilmFix Cloud Service Agreement (CSA)

FILMFIX CLOUD SERVICE AGREEMENT

This Cloud Service Agreement (“Agreement”) is between FilmFix (“Service Provider”) and any individual or entity using FilmFix’s Cloud services (“Customer”).

The cloud service uses Nextcloud software, which is licensed under AGPLv3. Source code is available here.

Service Description

FilmFix Cloud provides customers with temporary access to their digitized films and photos through a secure cloud-based platform. The service includes:

  • Ability to view and share with others
  • Give access to those you choose
  • Password-protected and End-to-End encrypted access
  • Web-based viewing and downloading of files
  • Creation of shareable links
  • We do not offer educational support services in steps required to use Nextcloud. (Please seek the Internet for usage instructions.)

Important: This is a TEMPORARY ACCESS SERVICE – it is not a backup solution.

Service Components

  • Storage Provider: Data is securely stored using Wasabi Technologies, Inc.
  • Hosting Provider: The Nextcloud platform is hosted by Metanet.ch
  • User Interface: Nextcloud provides secure access and file management
  • File Management: All file uploads and initial setups are performed exclusively by FilmFix
  • Data Protection: All data is encrypted before storage, preventing third-party access or use for AI training purposes

Subscription Terms

  • Annual subscription billing – check website for current pricing
  • Transparent tier-based pricing in 5GB increments
  • No setup fees or upload charges
  • Subscription fees are detailed separately, upon initiation and renewal

Customer Responsibilities

Customers agree to:

  • Keep login credentials confidential and secure
  • Not share login credentials with unauthorized users
  • Accept full responsibility for all activity under their account
  • Customer is responsible for all sharing of content and ensure they only share with appropriate recipients
  • Customer ensures all content provided to FilmFix is legal and that they have rights to such content
  • Comply with applicable laws during use of the FilmFix Cloud service
  • Use the service only for lawful purposes
  • Not attempt to reverse engineer, hack, or interfere with the service
  • Not attempt to modify provided Nextcloud functionalities

Critical Service Limitations

READ CAREFULLY – THIS IS TEMPORARY ACCESS ONLY:

  • FilmFix provides services strictly on an “AS IS” basis
  • NO GUARANTEE regarding service uptime, availability, access continuity, or performance
  • NO GUARANTEE of data recovery or backup services
  • NOT intended for long-term storage or backup
  • Service may be disrupted or discontinued at any time without notice
  • Service features, including sharing capabilities, may be dropped, modified, or added without notice
  • Access may be affected by service outages or technical issues

As always, FilmFix will keep a backup of your transfer for 30 days locally (not in the Cloud).

Customer Obligations

We strongly recommend that you:

  • Download files immediately after our upload notification
  • Create local backups in three places:
    1. On your computer’s internal hard drive
    2. On an external hard drive
    3. On an external hard drive stored off-site
  • Do not rely on Cloud access for important events

Remember: “If you don’t have your data in three places, you don’t have your data!”

CONDITION:  Data Retention and Liability
We maintain backup copies of your files on our systems for 30 days, as a courtesy; however, this backup service is not guaranteed. Further, you must notify us immediately of any issues or concerns regarding your files. All backup copies are permanently deleted from our systems after 30 days.

Data and Content

  • FilmFix does not own Customer’s data
  • Customer certifies that all content provided to FilmFix for upload to the Cloud is either original to them, or they own or have a license to use such content, or its use falls within fair use exception under copyright law
  • Customer certifies that uploading and sharing the content through FilmFix Cloud does not violate any rights of others or applicable copyright law
  • FilmFix relies on customer’s representation that content is legal and customer has appropriate rights
  • FilmFix will not knowingly store copyrighted commercial content (such as movies and television shows) that does not meet the above criteria
  • FilmFix has no responsibility for content accuracy, quality, or legality beyond the transfer process
  • Customer is solely responsible for ensuring they have rights to all content provided to FilmFix
  • Customer is solely responsible for their sharing decisions and ensuring shared content is appropriate for recipients
  • FilmFix reserves the right to remove content that violates terms or applicable law
  • Upon Service Termination, FilmFix may delete all customer data without further notice

Service Termination

FilmFix may suspend or terminate service immediately for:

  • Non-payment of fees
  • Violation of this agreement
  • Illegal use of the service
  • At FilmFix’s sole discretion with or without cause

Customer may cancel at any time but no refunds will be provided for unused service periods.

  • FilmFix expressly disclaims all warranties, explicit or implied, regarding the FilmFix Cloud services
  • FilmFix shall not be liable for any loss, damages, or inconvenience arising from service interruptions, data loss, unauthorized access, or other service limitations
  • This service is provided as a convenience through third-party services

Agreement and Acceptance

By selecting a Cloud access option, subscribing to FilmFix Cloud services, or using the FilmFix Cloud platform, the Customer acknowledges they have read, understood, and agree to be bound by these terms and conditions.

FilmFix reserves the right to modify these terms at any time without notice. Continued use of the service after any changes constitutes acceptance of new terms.
